Terms of Service

These Terms of Service (“Terms”) govern your access to and use of mypo (“Service”), the tool for managing mailing lists, drafting emails with AI, and sending campaigns from your Gmail account. By accessing or using mypo, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using mypo on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

mypo provides:

• Management of mailing lists and contacts
• AI-assisted email drafting and personalization
• Email campaign sending via Gmail integration
• Tracking of opens, clicks, and replies
• Template creation and management

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access and may modify, suspend, or discontinue features with reasonable notice.

3. Account Registration and Eligibility

To use mypo you must:

• Be at least 18 years old or have parental consent
• Provide accurate, current registration information
• Maintain the security of your account credentials
• Notify us promptly of any unauthorized access

You are responsible for all activity under your account. We reserve the right to refuse service, suspend, or terminate accounts at our discretion.

4. Gmail Integration

By connecting your Gmail account:

• You authorize mypo to send emails on your behalf through your Gmail account
• You agree to comply with Google’s API Services User Data Policy and Gmail’s Program Policies
• You retain full responsibility for emails sent through the Service
• OAuth tokens are stored encrypted and used solely for sending campaigns

Misuse of the Gmail integration, including sending spam or violating Google’s policies, may result in immediate account termination.

5. Acceptable Use

You agree not to:

• Send unsolicited commercial email (spam) or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
• Use the Service for illegal activities or to distribute harmful content
• Circumvent rate limits or attempt to gain unauthorized access to our systems
• Resell or sublicense the Service without our written consent
• Use the Service to send content that infringes intellectual property, is defamatory, or violates third-party rights
• Collect or process personal data without proper consent where required

We may monitor usage to ensure compliance and reserve the right to suspend accounts that violate these rules.

6. Your Content and Data

Ownership: You retain all rights to content you create and upload (lists, contacts, templates, campaigns). We do not claim ownership of your data.

License: You grant mypo a limited license to use, process, and store your content solely to provide and improve the Service (e.g., sending emails, generating AI drafts, backing up data).

Data portability: You can export your contacts and data at any time. Upon account deletion, we will delete your data within 30 days, except where we are required to retain it by law.

7. Payments and Billing

If you use paid features:

• Fees are as displayed at the time of purchase
• Payment is processed by our payment providers (Stripe, PayPal, or Dodo as applicable)
• Subscriptions renew automatically unless cancelled
• Refunds are governed by our Refund Policy

8. Limitation of Liability

To the maximum extent permitted by law:

• mypo is not liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
• We are not liable for loss of profits, data, or business interruption
• We are not liable for issues arising from Gmail, email deliverability, or third-party services

Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the maximum permitted by law.

9. Indemnification

You agree to indemnify and hold harmless mypo, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by mypo and protected by intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works without our written permission.

11. Termination

We may suspend or terminate your access:

• For violation of these Terms
• For non-payment
• If required by law
• At our sole discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of Italy. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Milano, Italy, except where mandatory consumer protection laws require otherwise.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
